Brief Definition
Do you need assistance and information regarding Will preparation and legal wills in Canada? Notarizers can help you in legal Wills preparation. We provide you a conducive atmosphere to discuss what you want your Will to look like and then prepare the necessary legal Will on your behalf. This is followed by preparing an initial and final draft of the Will.
What Is a Will and Why Do You Need One?
A Will is a legal declaration by which a person names one or more persons to manage his or her estate and provides distribution of his or her property at death. A Will can only be enforced after the death of its maker.
Once you have created your Will, you get sole discretion over the distribution of your assets. A legal Will lets you decide how to distribute your belongings, such as houses, cars or family possessions, business or investments that allow a smooth handover or transition of those assets.
Making a Will while you are alive gives you comfort of mind and it is the best thing that you can do for your family. If you do not have a Will, at your death, you will die intestate. In that case, the state will oversee the distribution of your assets. This has a lot of consequences, as your family may not necessarily receive all the things that belong to you.
Moreover, dying without a Will in Canada can create problems for those you leave behind. For example, your property could be divided according to the law, which may not be the same as the way you would have wanted them to be divided.
Sometimes you may experience delays and expenses involved in wrapping up your affairs. The court sometimes appoints a person to act as your personal representative, who may not be the one you choose to act as your estate trustee.
Generally, it is your closest relative who has the right to be appointed as your personal representative. A lawyer’s time and advice cost money, as they can make sure that you have considered all aspects of your estate and asset distribution, and draft your Will so that it aptly reflects your wishes. It is not every thing that you can print out from the internet as “Will Kit” that is valid. Most of those documents may not be accepted by the courts. The cost of retaining a lawyer to rectify the mistakes of a “Will Kit” is much higher than the cost of getting a lawyer to prepare a professional legal Will in the first place.
